Thus, before facing the problem of debt recovery (we presume that the problem will be dealt with by a powerful, reliable firm with excellent reputation, such as Alfa-Inform Group of Companies).
- It is necessary to thoroughly review strengths and weaknesses of the debtor (legal or physical body). Do you remember Chapay placing potatoes on the table and singing about the «Cherniy Voron» (black craw)? Yes, the dream of every debtor is to send you this «black craw», i.e. to show himself as a victim of blackmail and racket to the governmental authorities. Therefore lesson number one: an effective debt recovery is all about cruelty and reasonableness balance on one hand and complying with legislation on another.
- It is furthermore important to adequately estimate strong and weak sides of the situation to work out the optimal strategy to manipulate the debtor and to block or counterstrike the debtor’s actions. These actions we already have mentioned (e.g. application to the legislative authorities). But there are more defence remedies for a debtor:
- Change of location (office, residence address, work place, continuous business trips etc.);
- Continuous empty promises to pay off the debt;Counter-claim;
- Transaction of the assets to another legal body;
- Fabrication of the documents confirming paying off the debt;
- Using certain characteristics of the transaction (e.g. mistakes in the Contract, refusal to sign, loss of documentation etc.) the debtor may try to sui;
- The top-one remedy is the ultra new measure - anti-collection services.
